BeneMedical, LLC d/b/a Briye (“Briye”, “we” or “us”) is committed to protecting the privacy of Your Information. This Privacy Statement describes Briye’s privacy practices for Briye’s websites (http://www.briye.com/) including the services and information available at http://www.awvsolution.com or https://www.awvsolution.com/ (collectively the websites and services are referred to as the “Sites”). The Sites are intended for use by individuals in the United States. If you are not in the United States, please do not use our Sites or provide us with any personal information.
Our Sites are available only to users who can form legally binding contracts under applicable law. By using the Site, you represent and warrant that you are: (i) at least eighteen (18) years of age; and/or (ii) otherwise recognized as being able to form legally binding contracts under applicable law.
If you do not want Briye to use Your Information as stated in this Privacy Statement, please do not access the Sites.
The headings in this Privacy Statement are for convenience only and have no legal or contractual effect. By using the Sites, you represent that you are not a person barred from providing services under the laws of the United States or any of its states or any other applicable jurisdictions.
Information Collected
When you use our Sites, we may collect some generally non-identifiable information from you. This includes information that tracks the device you use to access our Sites (such as the type of device, the time and date of your access, your browser type, IP address, and other information related to how your device interacts with our Sites). In addition, we may collect location data of the device you are using to use our Sites.
We also collect information about you and your device through cookies, web beacons, and similar technologies. A “cookie” is a small data file sent from a website and stored on your device to identify your device in the future and allow for an enhanced personalized user experience. A “session cookie” disappears after you close your web browser, or may expire after a fixed period of time. A “persistent cookie” remains after you close your web browser and may be accessed every time you use our website. We may use both session and persistent cookies. You should consult your web browser to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may not be able to use certain features of our Sites.
We may also occasionally use “web beacons” (also known as “clear gifs,” “web bugs,” “1-pixel gifs,” etc.) that allow us to collect non-identifiable information about you. Web beacons are tiny images, placed on a web page or e-mail that can tell us if you have visited a particular area of our Site. Because web beacons are used in conjunction with persistent cookies (described above), if you set your browser to decline or deactivate cookies, web beacons cannot function.
There may be other tracking technologies now and later devised and used by us in connection with our Site. Further, third parties may use tracking technologies with our Site. We do not control those tracking technologies, and we are not responsible for them. However, you consent to potentially encountering third party tracking technologies in connection with your use of our Site and accept that this Privacy Policy does not apply to the tracking technologies or practices of such third parties. In such cases, you must check the third party websites to confirm how your information is collected and used.
When you are using the Sites, Briye may request certain information from you (“Your Information”). You can review background information and explanatory information about our Sites and services without providing us with any additional information. However, if you create an account or request additional information from us, you will need to provide us with certain other information.
For example, if you are requesting information, we will request contact information from you, such as your name, email address, telephone number. When registering to use the services at https://briye.com/ or https://www.awvsolution.com/, we will require you to provide certain information, such as your name, company name, address, phone number, NPI, fax number and email address. Once you have registered with https://briye.com/ or https://www.awvsolution.com/, you may provide us with health information of patients you are treating or your own health information (“Patient Information”). When You provide us with Patient Information, you represent you have the authority to do so, and if you are a health care professional, you are doing so in compliance with the requirements of the HIPAA Privacy Rule and state privacy laws and you have obtained any necessary consents and/or authorizations necessary prior to providing us with Patient Information.
Use of Information Collected
Briye uses Your Information and Patient Information to perform the services requested, which allow Briye to provide you with access to the offerings of our Sites including our products available at https://briye.com/ or https://www.awvsolution.com/. We may also use Your Information to contact you, to respond to a question you may have, to provide you with information about our products or Sites, or to otherwise communicate with you. From time to time we may ask for additional information to help us evaluate our products and our Site. We will not sell or rent Your Information or Patient Information. We will only share Your Information or Patient Information as described in the Privacy Statement.
When you are using the general information portion of our Sites, we may use Google AdWords Remarketing. AdWords Remarketing will display relevant ads tailored to you based on what parts of the Sites you have viewed by placing a cookie on your machine. THIS COOKIE DOES NOT IN ANYWAY IDENTIFY YOU OR GIVE ANYONE ACCESS TO YOUR COMPUTER. The cookie is used to say “This person visited this page, so show them ads relating to that page.” Google AdWords Remarketing allows us to tailor our marketing to better suit your needs and only display ads that are relevant to you.
Sharing of Information with Third Parties
Briye may work with business partners in making our services available to you. Our policy is to require companies with whom we do business to support the same privacy policies we do. We will share information only as necessary for the third party to provide related services or assist us in providing the Sites and our services and products. These parties are not allowed to use Your Information or Patient Information except for the purpose of providing services to us.
We also reserve the right to disclose Your Information or Patient Information that we believe, in good faith, is appropriate or necessary to: (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Sites and any facilities or equipment used to make the Sites available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others. We will notify you of any such disclosures.
De-Identified Information: On occasion, Briye may share certain de-identified aggregate information in order to assist Briye in improving its services. De-identified individual information is information in a form that would not allow anyone studying the information to personally identify a person.
Aggregate information is information that describes the habits, usage patterns and/or demographics of users as a group but does not reveal the identity of particular users. Your anonymous data may be combined with the anonymous data of other users of the Sites and becomes statistics. We may use aggregate information within Briye to understand the needs of individuals using our Sites.
Law Enforcement and Protection of Users and the Site
To the extent permitted by law, Briye may disclose Your Information or Patient Information to governmental authorities or third parties pursuant to a legal request, subpoena or other legal process. Briye may also use or disclose Your Information as permitted by law to apply or enforce the Terms of Use, or protect Briye’s rights, interest, or property as well as those of our affiliates. Following such disclosure to any third party, Your Information may be accessible by others to the extent permitted or required by applicable law.
Security
Briye uses robust security measures to protect Your Information and Patient Information from unauthorized access, maintain data accuracy, and help ensure the appropriate use of Your Information and Patient Information. When you access the Sites using modern web browsers, Secure Socket Layer (.SSL.) technology protects Your Information and Patient Information using both server authentication and data encryption. These technologies help ensure that Your Information and Patient Information is safe and secure. We also have implemented an advanced security method based on dynamic data and encoded session identifications, and hosts its web sites in a secure server environment including firewalls, intrusion detection systems, and other advanced technology to prevent interference or access from unauthorized users. Unfortunately, no web site, server or database is completely secure. Briye cannot guarantee that Your Information or Patient Information will not be disclosed, misused or lost by accident or by the unauthorized acts of others. You are responsible for maintaining the security and confidentiality of any usernames and passwords you need to access the Sites.
Do Not Track
For web browser use, you may set your browser to refuse these data collection methods, but we do not recognize or respond to “do not track” technologies employed by your browser. We may track our App users over time and across third party websites or online services and we do not specifically respond to Do Not Track (“DNT”) signals for those technologies.
California Shine the Light Law
California Civil Code Section 1798.83, known as the “Shine the Light” law, permits individuals who are California residents to request and obtain from us a list of Your Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. We will never disclose Your Information to third parties for direct marketing purposes without your authorization. Requests may be made only once a year and are free of charge.
Changes to this Privacy Statement
Briye reserves the right to change this Privacy Statement, and when updated, the effective date of the new version will be at the top of this statement.
Assignment
Your Information and Patient Information will remain subject to the terms of this Statement of Privacy even if we undergo an organizational transition. However, we may transfer Your Information and Patient Information to a successor entity upon a merger, consolidation, or other reorganization in which Briye participates. You hereby consent to such transfers and Briye may assign and transfer all of the rights, benefits, duties, and obligations of this Privacy Statement, under the circumstances described in this paragraph.
